The District Consumer Disputes Redressal Commission, Central Mumbai, asserted that the deliberate cancellation of the order was a tactic aimed at maximizing profits, constituting a lapse in service and an unjust trade practice by the online platform. The commission emphasized that despite receiving a refund, the customer deserved compensation for the emotional distress caused by the abrupt cancellation of the order.

According to the complainant, a resident of Dadar, he purchased an iPhone from Flip kart on July 10, 2022, for ₹39,628 via credit card payment. The scheduled delivery date was July 12, but six days later, he received notification that his order was canceled, citing alleged delivery attempts by the company’s Ekart service.

The complainant argued that the cancellation not only resulted in financial loss and emotional distress but also exposed him to online fraud. While Flipkart’s delivery partner, Ekart Logistics, was named in the complaint, the commission ruled that it was not directly liable as it functioned as a delivery service.

Flipkart, in its defense, stated that it merely served as an intermediary platform and the transaction was between the complainant and the seller, International Value Retail Private Limited. The company asserted that it promptly informed the seller about the complaint, which claimed unsuccessful delivery attempts.

However, the commission found Flipkart’s unilateral cancellation suspicious, especially considering the complainant’s ongoing communication with the company regarding the issue. Flipkart’s admission that the order was canceled, coupled with the subsequent increase in the product’s price, suggested a profit-driven motive behind the cancellation.

Consequently, the commission ordered Flip-kart to pay ₹10,000 in compensation for the emotional distress caused to the complainant, along with ₹3,000 towards expenses.
